PRIVACY POLICY: EL VAQUERO BEVERAGES

This Privacy Policy describes how Tasty Enterprises, LLC (dba El Vaquero Beverages) collects, uses, and protects your information when you visit www.elvaquerobeverages.com.

1. INFORMATION WE COLLECT

To provide you with our premium beverages and a secure shopping experience, we collect:

  • Identity & Contact Data: Name, shipping/billing address, email, and phone number. This is used solely for order fulfillment and customer communication.
  • Mandatory Age Verification Data (Texas DSHS §300.701): To comply with Texas and Federal law, we must verify you are 21+.
    • We use AgeChecker.net to match your name, address, and DOB against secure public records.
    • Government IDs: If a database match fails, you may be required to upload a photo of your government-issued ID. El Vaquero does not store these images; they are processed securely by AgeChecker and deleted promptly after verification. We only store your "Verified" status.
  • Marketing & Communications Data: We collect your preferences in receiving marketing from us and our third parties, as well as data regarding your interaction with our social media content (e.g., Instagram Reels and Meta-integrated ads).
  • Transaction Data: Details about payments and the products you’ve purchased. (Payment info is handled securely by our processors, such as Shopify Payments).
  • Technical Data: IP address, browser type, and how you interact with our site (via cookies and pixels).

2. HOW WE USE YOUR INFORMATION

We use your data for the following essential business purposes:

  • Order Fulfillment: To process, ship, and track your premium beverage orders.
  • Regulatory Compliance: To verify your age and identity via AgeChecker.net, ensuring we adhere to Texas DSHS §300.701 and federal age-restriction laws for hemp-derived products.
  • Customer Communication: To provide updates on your "trail" with El Vaquero (order status) and, with your consent, share news about new products or Cowboy-inspired content.
  • Safety & Fraud Prevention: To protect our customers and our business from fraudulent transactions, malicious activity, and to maintain the integrity of our 21+ secure gateway.
  • Legal Defense: To maintain necessary records of "Lawful Use in Commerce" as required for our federal trademark protections and state licensing audits.

3. HOW WE SHARE YOUR DATA

We do not sell your personal information. We only share data with trusted partners ("Processors") necessary to fulfill your order and maintain legal compliance:

  • Shopify Inc.: Our e-commerce platform provider. They process your transaction data and provide the secure environment for our storefront.
  • Fulfillment & Logistics Partners: Third-party warehouses and carriers (e.g., UPS, FedEx) who receive your name and address solely to deliver your El Vaquero beverages.
  • AgeChecker.net (Age Verification): To comply with Texas DSHS §300.701, we share your name, address, and DOB with AgeChecker.net. If a manual ID upload is required, AgeChecker.net processes that sensitive data over a secure, encrypted connection. They are prohibited from using this data for any purpose other than verification for El Vaquero.
  • Government & Regulatory Bodies: We may disclose your information to the Texas Department of State Health Services (DSHS) or other law enforcement agencies if required to demonstrate compliance with age-gate audits, subpoenas, or other legal mandates.
  • Meta Platforms, Inc. (Facebook/Instagram): We share certain "Business Activities" and technical data with Meta to optimize our advertising and provide you with relevant content. This includes data collected via the Meta Pixel or other integration tools, which helps us measure the effectiveness of our social media campaigns and deliver targeted ads based on your interests.
  • Strategic Business Transfers: In the event of a merger, acquisition, or sale of Tasty Enterprises, LLC assets, customer data (excluding sensitive ID images) may be transferred as a business asset.

4. COOKIES & TRACKING

We use cookies to remember your cart and analyze site traffic. You can disable cookies in your browser settings, though it may affect your ability to checkout. We do not currently respond to "Do Not Track" signals.

5. YOUR RIGHTS (TEXAS & U.S.)

Depending on your state of residence, you may have the right to:

  • Access: Request a copy of the data we hold about you.
  • Correction: Ask us to fix inaccurate info.
  • Deletion: Request that we delete your personal data (subject to our legal requirements to keep tax and compliance records). To exercise these rights, email legal@elvaquerobeverages.com.
  • Opt-Out of Targeted Advertising: Under the Texas Data Privacy and Security Act, you have the right to opt-out of the processing of your personal data for the purposes of targeted advertising. To exercise this right, you may adjust your ad preferences within your Meta (Facebook/Instagram) account settings or contact us at legal@elvaquerobeverages.com with the subject line “Opt-Out of Targeted Advertising.”

6. DATA SECURITY & RETENTION

We employ industry-standard 256-bit AES encryption and secure socket layer (SSL) technology to protect your data. Our retention policies are governed by the principle of "Data Minimization":

  • Verification Images: In compliance with our privacy-first commitment, any images of government-issued identification uploaded to AgeChecker.net are used for instantaneous verification and are deleted promptly (typically within 24 hours) once your age is confirmed. We do not host or store these images on our servers.
  • Compliance Records: We retain a "Verified" status token and the date of verification for a period of five (5) years, as required by Texas DSHS record-keeping mandates (§300.205) to demonstrate our history of age-restricted sales during state audits.
  • Transaction & Tax Data: We retain order history and billing information for seven (7) years to satisfy federal and state tax obligations.
  • Inactive Accounts: Personal data associated with accounts that have shown no activity for more than three (3) years will be de-identified or deleted, unless legal hold requirements apply.

7. CHILDREN’S PRIVACY

Our services are strictly for adults 21+. We do not knowingly collect data from anyone under 21. If we discover we have accidentally collected such data, it will be deleted immediately.

VERSION HISTORY & UPDATES

  • February 23, 2026 (Version 1.0): Initial Privacy Policy for El Vaquero Beverages launch.
  • March 31, 2026 (Version 1.1): Significant update to comply with finalized Texas DSHS Chapter 300 regulations and the Texas Data Privacy and Security Act (TDPSA). Key changes include the formal disclosure of AgeChecker.net as a third-party processor and the implementation of a 24-hour deletion protocol for government-issued identification images.
  • April 4, 2026 (Version 1.2): Updated to include disclosures for Meta Business Activities and targeted advertising in compliance with the Texas Data Privacy and Security Act (TDPSA). Added explicit consumer opt-out rights for targeted advertising.
