TERMS OF USE AGREEMENT: EL VAQUERO BEVERAGES

1. ACCEPTANCE, ELIGIBILITY & AGE VERIFICATION

This Terms of Use Agreement (“Agreement”) is between Tasty Enterprises, LLC (“we,” “us,” or “our”) and the user (“you”). This Agreement governs your use of www.elvaquerobeverages.com (the “Website”) and the purchase of any products.

MANDATORY AGE VERIFICATION (Texas DSHS §300.701): You must be at least twenty-one (21) years of age to access this Website or purchase our products. In accordance with Texas Department of State Health Services (DSHS) Rule §300.701, we require valid proof of government-issued identification for every transaction.

THE VERIFICATION PROCESS: We utilize AgeChecker.net, a third-party identity and age verification service, to confirm your eligibility. By using this site, you acknowledge and agree to the following:

  • Data Processing: You consent to the collection and transmission of your name, address, and date of birth to AgeChecker.net for the purpose of matching your identity against authoritative public records and credit data.
  • ID Submission: If a database match is not possible, you will be required to upload a clear photo of your government-issued ID.
  • Data Privacy & Security: Your information is transmitted over a secure 256-bit AES encrypted network. AgeChecker.net does not sell your data. Photo ID images are used solely for the immediate verification process and are deleted promptly after verification is complete.
  • Refusal of Service: Providing false information, using a forged ID, or attempting to bypass the verification gate is a material breach of this Agreement. We reserve the right to cancel any unverified order without a refund.

 

2. THE SHOPIFY PLATFORM

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. By using this Website, you acknowledge that your interaction with the storefront is also subject to Shopify’s standard data processing and security protocols. However, Shopify is not responsible for the products themselves or the content provided by El Vaquero.

3. COMPLIANCE & LOCAL LAWS

El Vaquero products contain hemp-derived THC and cannabinoids.

  • Federal Status: Our products are hemp-derived and contain no more than 0.3% Delta-9 THC by dry weight, in compliance with the 2018 Farm Bill.
  • Your Responsibility: THC legality varies by jurisdiction. You are responsible for ensuring that the purchase and possession of our products are legal in your specific location. We reserve the right to refuse service or shipping to any jurisdiction where local laws restrict our products.

4. INTELLECTUAL PROPERTY & CONDUCT

Tasty Enterprises, LLC owns all rights to the El Vaquero name, logos, and "modern cowboy" branding. You are granted a limited license to use the site for personal, non-commercial shopping. You may not "scrape" our data, use our trademarks without permission, or attempt to bypass any site security.

5. TERMS OF SALE & RETURNS

  • Orders: We reserve the right to limit or cancel any order.
  • Returns: Due to the consumable nature of our beverages, all sales are final. If your product arrives damaged, please contact us within 48 hours of delivery at the contact email below.
  • Accuracy: We strive for accuracy, but we do not warrant that product descriptions or prices are error-free. In the event of a pricing error, we reserve the right to cancel the order and issue a refund.

6. DISCLAIMER OF WARRANTIES

EL VAQUERO PRODUCTS ARE PROVIDED "AS IS." To the maximum extent permitted by law, we disclaim all warranties, express or implied. Our products have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.

7. DISPUTE RESOLUTION & BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

  • Arbitration: You and Tasty Enterprises, LLC agree that any dispute or claim arising out of your use of the Website or products shall be settled by binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures.
  • Venue: The arbitration shall take place in Collin County, Texas.
  • Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  • Opt-Out Right: You may opt out of this arbitration agreement within 30 days of your first purchase by sending an email to legal@elvaquerobeverages.com with the subject line "Arbitration Opt-Out."

8. COPYRIGHT INFRINGEMENT (DMCA)

If you believe that any content on our Website infringes your copyright, please notify our Designated DMCA Agent:

9. GOVERNING LAW

This Agreement and any dispute related thereto will be governed by the laws of the State of Texas, without regard to conflict of law principles.

11. SUBSCRIPTION TERMS & AUTOMATIC RENEWAL By signing up for an El Vaquero subscription, you agree to an initial and recurring monthly subscription fee at the then-current subscription rate. You accept responsibility for all recurring charges until you cancel your subscription.

  • Automatic Renewal: Your subscription will automatically renew at the frequency chosen (e.g., every 30 days). Your payment method will be charged on the anniversary of your initial order.
  • Cancellation Policy: You may cancel your subscription at any time through your Account Portal or by emailing hello@elvaquerobeverages.com. To avoid being charged for your next shipment, you must cancel at least 48 hours before your next scheduled billing date.
  • Click-to-Cancel: In compliance with federal and state laws, El Vaquero provides a simple, online mechanism for cancellation. No phone calls or retention hurdles are required.
  • Modifications: We reserve the right to change subscription prices or terms with 30 days’ notice. Your continued participation after the notice constitutes acceptance.

 

12. TEXAS REGULATORY COMPLIANCE As a brand operating under Texas Consumable Hemp Product (CHP) regulations, you acknowledge that El Vaquero Beverages adheres to 25 TAC Chapter 300, including:

  • Total THC Limits: All products are tested to ensure they do not exceed 0.3% Total THC (Delta-9 THC + 0.877 * THCA) per container.
  • Recordkeeping: We maintain Batch Production Records for all products, which are available for inspection by DSHS officials as required by law.
  • Marketing: We do not market our products in a manner that is "attractive to children" as defined by the latest DSHS standards.
